Maximum sulphur content in gas oil
5. No person shall use gas oil—

(a) until 31st December 2007, with a sulphur content exceeding 0.2 percent by mass; or

(b) on or after 1st January 2008, with a sulphur content exceeding 0.1 percent by mass.
Sampling and analysis
6. —(1) The Secretary of State shall take all necessary measures to ensure that sampling is carried out of heavy fuel oil and gas oil to check that the use of those fuels complies with regulations 4(1) and 5.

(2) Sampling shall be carried out with sufficient frequency and in such a way that the Secretary of State is satisfied that the samples are representative of the fuels examined.

(3) Sampling in respect of compliance with regulation 5(b) shall commence no later than 1st July 2008.

(4) Schedule 2 has effect in relation to the technical requirements for determining the sulphur content of fuel sampled under paragraph (1).

30/11/2007Chief Executive/Board Member with special responsibility for health and safety, in accordance with local procedures ensure that this Alert is brought to the attention of appropriate staff who should take the following action
1) Identify, if present, Gas Oil stored on the premises.
2) Where possible, make arrangements to use this fuel before 01 January 2008, due to the new limits on sulphur content from 0.2% to 0.1% being introduced.
3) If the fuel cannot be used contact your local enforcement agency (Local Authority/ Environment Agency) to discuss options.
4) Contact your fuel supplier to establish, i) the recommended storage life of the fuel. ii) that all fuel supplied after 01 January 2008 will comply with the new regulations. Background1)
In a recent HEFMA (Health Facilities Management Association) meeting, discussiontook place on “The Sulphur Content of Liquid Fuel (England and Wales) Regulations 2007”.
2) Some Healthcare organisations hold secondary fuel in a duel fuel boiler system and / or for standby generators.
3) Enforcement agencies may allow the current 0.2% sulphur Gas Oil to be used until 31 December 2008, provided the holder can demonstrate that they have made reasonable efforts to comply.
